General Terms & Conditions

§ 1 Scope, provider

(the "Provider").

(2) A consumer is any natural person who concludes a legal transaction for purposes that are predominantly outside their trade, business or profession (§ 13 German Civil Code, BGB). An entrepreneur is a natural or legal person or a partnership with legal capacity that, when concluding a legal transaction, acts in the exercise of its trade, business or profession (§ 14 BGB).

(3) The version of the Terms valid at the time of the order is decisive.

§ 2 Conclusion of contract

(1) The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order (invitatio ad offerendum).

(2) By clicking the order/buy button and completing the payment process via the payment service provider Stripe, you submit a binding offer to purchase the goods contained in the cart. The purchase contract is concluded when the Provider accepts your order by an order confirmation in text form (e.g. by email) or delivers the goods. If you receive an automatic order confirmation immediately after submitting the order, in which the acceptance of the order is expressly declared, the contract is concluded upon receipt of this confirmation.

(3) Order processing and contact generally take place by email and automated order processing. You must ensure that the email address you provide is correct and that the receipt of messages is technically ensured, in particular not prevented by spam filters.

(4) The contract text is stored by the Provider and sent to you in text form together with these Terms after you submit your order. You can also view the Terms on this website at any time.

§ 3 Prices and shipping costs

(1) The prices stated are final prices in euros. In accordance with § 19 UStG, no value added tax is charged and therefore not shown (small-business regulation).

(2) In addition to the stated prices, shipping costs may apply. Shipping costs are staggered depending on the order value and are clearly communicated to you on the product pages and at the latest during the ordering process before you place the order.

(3) The applicable shipping costs depend on the order value and the delivery destination. The exact amount is shown to you in the order overview before completing the order.

§ 4 Delivery, delivery area, delivery time

(1) Delivery takes place within Germany and to the member states of the European Union.

(2) Unless stated otherwise on the respective product page, the delivery time for series products is generally 3 to 7 working days after conclusion of the contract. For individual commissioned work / custom productions, the delivery time is extended accordingly; the expected production and delivery time is communicated individually before conclusion of the contract.

(3) The Provider's products are hand-cast concrete items. Each piece is unique. Minor deviations in colour, structure, surface and dimensions are due to the production process, typical of the material, and do not constitute a defect.

(4) Should an ordered product be unavailable, the Provider will inform you without undue delay. Payments already made will be refunded without undue delay in this case.

§ 5 Payment

(1) Payment is made via the payment service provider Stripe (Stripe Payments Europe, Ltd.) using the payment methods offered there. Payment data is entered directly in the secure environment of Stripe (Stripe Hosted Checkout).

(2) The purchase price is due for payment upon conclusion of the contract and must be paid as part of the payment process.

(3) The respective terms of the payment service provider Stripe apply in addition.

§ 6 Retention of title

The delivered goods remain the property of the Provider until full payment.

§ 7 Right of withdrawal

(1) Consumers have a statutory right of withdrawal. The details can be found in the Provider's separate withdrawal policy.

(2) The right of withdrawal does not apply to contracts for the supply of goods that are not prefabricated and that are made on the basis of an individual choice or decision by the consumer, or that are clearly tailored to the consumer's personal requirements (§ 312g(2) no. 1 BGB). This applies in particular to individually manufactured commissioned work. You will be informed separately of this before placing a corresponding order.

§ 8 Warranty / liability for defects

(1) The statutory rights for defects apply.

(2) Material-typical properties of hand-crafted unique concrete items (cf. § 4(3)) do not constitute a material defect.

(3) If the buyer is an entrepreneur, the warranty period for delivered goods is, by way of derogation, one year from delivery of the goods; the statutory limitation periods for the right of recourse pursuant to §§ 478, 479 BGB remain unaffected.

§ 9 Liability

(1) The Provider is liable without limitation for damages resulting from injury to life, body or health, as well as for damages based on an intentional or grossly negligent breach of duty.

(2) For other damages, the Provider is liable only insofar as they are based on the breach of a material contractual obligation (cardinal obligation). Material contractual obligations are those whose fulfilment makes the proper performance of the contract possible in the first place and on whose compliance the contractual partner may regularly rely. In this case, liability is limited to the foreseeable damage typical for the contract.

(3) Otherwise, liability is excluded. Liability under the Product Liability Act remains unaffected.

§ 10 Dispute resolution

(2) The Provider is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

§ 11 Final provisions

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection granted by mandatory provisions of the law of the state of the consumer's habitual residence.

(2) Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions remains unaffected.
